Terms & Conditions

1. These terms and conditions (“T&C”) apply for your use of our products and services, including our product rental services (the “Services”) and, by using the Services, you agree to these T&C.

2. You confirm that you are at least 18 years old and are authorized to use the chosen payment method (including, without limitation, credit cards) for the purpose of purchasing the Service.

Booking & Rental Service

3. We aim to provide apparel and accessories (the “Product(s)”), on a rental basis, to you (the “Rental Service”). Reservation for a Product can be done at any of our physical stores in Singapore, or through our WhatsApp Business account at the number +65 9739 1487.

4. Rental Service for a Product will only be deemed confirmed upon full payment of Fees and the Deposit, as indicated in the Fees & Payment section below. Products can be picked up from our store or delivered to your desired location, based on applicable charges. Products may appear different in colour and style than as displayed on the Site.

5. We will use best endeavours to deliver the Product you have ordered, including the specified size, colour and design, on or before the delivery date for which you ordered them. But in the exceptional event that prevents timely delivery of the Product (for example, the Product is/was damaged beyond repair), we will notify you that the Product is unavailable through your specified contact number. If we are able to reach you, you will be entitled to choose any available rental Product to replace the unavailable Product. If we are unable to reach you, you acknowledge and agree that we may send you a replacement product of the same or greater value. You may also opt to order another Product from a different style (“Additional Style”) for a reduced rate, as set forth on the Site. You may not however, choose both an Additional Size and an Additional Style at the same time. You may select an Additional Style that is more expensive than your first Product of choice, however when you do select a more expensive Additional Style, the total rental price will be adjusted. You can rent an Additional Style for the same period that you order the first Product. Any Additional Products must be returned together with the Product with which it was ordered. These Terms apply to any Additional Products just as to any other Product. We may discontinue the availability of Additional Size and Additional Style at any time.

6. All Products remain our property (legal and beneficial), at all times, including during the period of the Rental Service.

Delivery & Receipt

7. Upon delivery of the Product, you will bear full responsibility for the Product. You acknowledge that a Secure Shipping Address is highly recommended. If an unsecured shipping address is provided, we will not bear any liability for Products left unattended. You acknowledge that providing anything other than a Secure Shipping Address may result in delivery delays and additional delivery fees for which we will not be liable. You will be liable for all such delays and additional delivery fees.

Fees & Payment & Receipt

8. The fees for the Rental Service will be the total of the rental fee, insurance charges, laundry charges and applicable taxes (the “Fees”).

9. There will also be a separate payable deposit (the “Deposit”), which will be the retail price of the Product (which is the price at which the product can be purchased outright, either at our store or website www.coldwear.com), minus the Fees.

10. The Deposit will be returned to you, within 7 days after you return the Product to us. We may ask for your Bank Account Information for Deposit refund if you paid your Fees and Deposit through means other than a credit card.

11. If you return the Product later, or not at all, than the scheduled return date, your deposit may be reduced or forfeited entirely, in our favour, to pay for the Late Fee.

12. If you return the Product with damage, we may choose to withhold your Deposit, until we establish the cost of repair / replacement (“Cost of Damage”). After our assessment and confirmation of the Cost of Damage, it will be deducted from the Deposit in our favour.

13. When you place your order for a Rental Service, you authorize us to charge your payment card for the Fees. In addition, at the time of your order for a Product, you authorize us to charge your payment card for the Fees and Deposit, as mentioned under these T&Cs, provided that we will only charge your payment card for an amount greater than the Fees for events such as a Late Return.

14. If the Scheduled Return Date passes and the Products have not been returned, you will be charged a daily late fee (“Late Fee”). The Late Fee will be calculated by taking the Deposit value and dividing it by 7. The Late Fee is payable for every Product that is not fully returned, including any one or more of its parts (if any).

15. If you are charged with Late Fees which exceed the value of the Deposit, your late return will be considered a non-return, and you will be charged the full retail price of the Product you have not returned, in addition to the forfeiture and/or exhaustion of the Deposit (as the case may be).

Cancellation & Receipt

16. You may cancel your rental order no later than 3 (three) days before the delivery or collection date. There will be a cancellation fee of 30% which will be deducted from your paid Fees and you will receive the remaining amount, which will be paid to your issued payment card. We may ask for your Bank Account Information for Deposit refund if you paid your Fees and Deposit through means other than a credit card.

Use & Return & Receipt

17. You agree to treat the Products with great care.

18. You are not required to wash or launder the Products during or after the Rental Service.

19. Products should be returned to us at our physical stores, by the Scheduled Return Date for the rental of the products.

20. If you are unable to return the products through in-store drop-off, you may request us to pick up the product from the desired pick-up address you designate. However, in such an event, you will be charged and liable for all the costs arising out of such method of return.

21. Failure to receive products on time, whether by way of request or due to the Scheduled End Date (as the case may be) will give us the right to charge for the products up to the full retail price and take other action as detailed under the Late Fee Section below.

22. If you return the Products prior to the Scheduled Return Date, you will not be refunded, credited, or returned any monies for an early return.

Loss & Damage & Receipt

23. You agree to inform us of the chronology of any loss or damage to the Products, which may include but are not limited to, theft, loss, fire, major stains or any other cause, other than normal wear and tear, which we may, in our discretion, deem appropriate to inquire.

24. In the event of loss due to theft, loss, fire or any other cause, of a Product, we may at our discretion charge you the price for replacing the Product, up to the full retail value for the Product.

25. You confirm that prior to use of any Product that you will be responsible for checking the Product, and that the Product is fit-for-use, and contain no defects and contain no objects or materials that may have a detrimental effect on your personal wellbeing. You acknowledge that there is no defect or risk of danger or injury from the Product rented prior to your use of the Product.

Miscellaneous & Receipt

26. If any term, or part of any term, held to be unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining terms.

27. These T&C are governed by and interpreted pursuant to the laws of Singapore. Parties agree to submit to the exclusive jurisdiction of the courts of Singapore.
